AN ORDINANCE OF THE BOROUGH OF GETTYSBURG

REPEALING CHAPTER 5, PARTS 1, 2, 3, AND 5 OF THE CODE OF ORDINANCES OF THE BOROUGH OF GETTYSBURG RELATIVE TO THE BUILDING CODE, ELECTRICAL CODE, FIRE PREVENTION CODE AND PLUMBING CODE.

WHEREAS, by Ordinance No. 1292-04, enacted on June 14, 2004, the Borough Council of the Borough of Gettysburg adopted the Uniform Construction Code and incorporated the Uniform Construction Code by reference as the municipal building code of the Borough of Gettysburg; and

WHEREAS, Chapter 5, Parts 1, 2, 3, and 5 of the Code of Ordinances of the Borough of Gettysburg govern the "Building Code," the "Electrical Code," the "Fire Prevention Code," and the "Plumbing Code," respectively; and

WHEREAS, the substance of Chapter 5, Parts 1, 2, 3, and 5 of the Code of Ordinances of the Borough of Gettysburg is and has been superseded by the Uniform Construction Code.

NOW, THEREFORE, the Borough Council of the Borough of Gettysburg hereby enacts, adopts, and ordains the following:

SECTION 1: Chapter 5, Part 1 of the Code of Ordinances of the Borough of Gettysburg, entitled "Building Code" is hereby repealed as it is superseded by the Uniform Construction Code.

SECTION 2: Chapter 5, Part 2 of the Code of Ordinances of the Borough of Gettysburg, entitled "Electrical Code" is hereby repealed as it is superseded by the Uniform Construction Code.

SECTION 3: Chapter 5, Part 3 of the Code of Ordinances of the Borough of Gettysburg, entitled "Fire Prevention Code" is hereby repealed as it is superseded by the Uniform Construction Code.

SECTION 4: Chapter 5, Part 5 of the Code of Ordinances of the Borough of Gettysburg, entitled "Plumbing Code" is hereby repealed as it is superseded by the Uniform Construction Code.

SECTION 5: Chapter 5, Part 4 of the Code of Ordinances of the Borough of Gettysburg, entitled "Property Maintenance Code" shall be renumbered and identified in the Code of Ordinances as Chapter 5, Part 2.

SECTION 6: Chapter 5, Part 6 of the Code of Ordinances of the Borough of Gettysburg, entitled "Uniform Construction Code" shall be renumbered and identified in the Code of Ordinances as Chapter 5, Part 1.

SECTION 7: All remaining provisions of Chapter 5 of the Code of Ordinances of the Borough of Gettysburg shall remain in full force and effect unless otherwise repealed by any other ordinance. All other ordinances and parts of ordinances inconsistent herewith are hereby repealed only to the extent that the same are inconsistent herewith.

SECTION 8: This Ordinance shall become effective upon enactment.

ENACTED, ADOPTED, AND ORDAINED on this 10th day of May, 2010.
